Terms of Service
Effective October 11, 2026
These Terms govern your use of ClaimStaker (the "Service"), a product of Imagery Atlas operated by USMiner ("we", "us"). By creating an account, subscribing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What ClaimStaker does, and does not do
ClaimStaker is software that helps you lay out unpatented mining claims on public survey data and prepares documents (location notices, certificates of location, claim maps and checklists) from information you provide. ClaimStaker is not a law firm, an attorney, a land surveyor or a title company, and does not give legal, surveying or tax advice. Using the Service does not create an attorney-client or other professional relationship.
You are solely responsible for: confirming that land is open to mineral entry and not already claimed; making a discovery; locating, posting and monumenting your claims on the ground; the truth and completeness of what you enter and sign; recording and filing within all deadlines; paying all government fees; and keeping your claims. Survey, map and land data come from third parties (including BLM, USGS and the U.S. Census Bureau) and may be incomplete, out of date or inaccurate. Section corner positions are approximations, and computed bearings and distances are not a survey. The Service does not currently show land withdrawals or existing mining claims. Laws, fees and recorder requirements change, and recorders and BLM make their own decisions; we do not guarantee that any document will be accepted or that any claim will be valid.
2. Accounts
You sign in with a Google account. You must be at least 18 years old and able to form a binding contract. Keep your account secure and do not share it; you are responsible for activity under it. You must provide accurate information, and you may enter information about other people (such as co-locators) only with their permission.
3. Plans, allowances and fair use
Each plan allows a number of claims at a time and a number of new claims per week or month, as shown on the pricing page when you subscribe. A claim counts the first time its paperwork is prepared; preparing the same claim again, or changing only its name, locators or notes, does not count again, while changing its location or shape makes it a new claim. Allowances do not roll over. We may change plan features and allowances for future billing periods with notice.
4. Subscriptions, automatic renewal and cancellation
Paid plans renew automatically at the end of each monthly or yearly billing period, and we charge your payment method the then-current price plus applicable taxes, until you cancel. You can cancel at any time in Account › Manage billing; cancellation takes effect at the end of the current billing period and you keep your plan until then. We will notify you before a price increase applies to your subscription, and you may cancel before it takes effect.
Commercial plan claims beyond the monthly allowance are billed per claim at the published overage rate on your next invoice. Payments are processed by Stripe under its terms; we do not store your card details. If a payment fails we may retry it, and your plan may revert to the free plan until payment is made.
Changing plans. If you switch to a different plan or billing period, you pay for the new plan at checkout. Your previous subscription then ends, and the unused part of what you paid for it is credited to your account balance and applied to your future invoices; it is not refunded to your payment method. Any overage claims not yet billed are billed when the previous subscription ends.
Refunds. Fees are non-refundable except where required by law. If you believe you were charged in error, contact us within 30 days and we will review it in good faith.
Government fees (BLM, county and state) are not included and are paid by you directly to those offices.
5. Acceptable use
You agree not to: use the Service for any unlawful purpose, including locating claims through fraud or with fictitious ("dummy") locators; copy, scrape, harvest or bulk-download data or documents by automated means; reverse engineer, decompile or attempt to extract the Service's source code, rules or methods; copy, reproduce or create a competing product from the Service or its design; resell or provide the Service to others except as your plan allows; interfere with the Service's security or operation; or share accounts.
6. Intellectual property
The Service, including its software, design, text, rules data and documents' layout, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service under these Terms. You may use, copy, record and file the documents prepared for your claims. You keep ownership of the information you enter, and you grant us a license to host and process it to provide and improve the Service and as described in the Privacy Policy.
7. Third-party services
The Service relies on third-party services (including Google sign-in, Stripe, our hosting provider, public BLM, USGS and Census map services, and, when you choose them, Google and Esri aerial imagery). We are not responsible for their availability or content. If you use Google imagery in the Service, you also agree to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
8. Disclaimer of warranties
THE SERVICE AND ALL DOCUMENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MINING CLAIMS, MINERAL RIGHTS, PROFITS, DATA OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 IF GREATER. Some jurisdictions do not allow these limits, so they may not apply to you.
10. Indemnity
You will defend and indemnify us against third-party claims arising from your claims, your documents, the information you provide or your breach of these Terms.
11. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or put the Service at risk. Sections 1 and 6 through 13 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the state in which we have our principal place of business, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located there, except that either party may bring a claim in small claims court where it qualifies.
13. Changes
We may update these Terms. We will post the new Terms with a new effective date and, for material changes, notify you by email or in the Service. Continuing to use the Service after changes take effect means you accept them.
